This website (the “Site”) is operated by The Nurse Rooted, LLC, doing business as The Nurse Rooted Co. (“The Nurse Rooted Co.,” “we,” “us,” or “our”). We provide educational content and resources, downloadable digital products, mentorship and coaching services, workshops and bootcamps (live and recorded), consulting, community offerings, and related materials (collectively, the “Services”).

By visiting the Site and/or purchasing or accessing any Services, you agree to be bound by these Terms & Conditions (the “Terms”), including any additional terms, policies, notices, or agreements referenced here or available via hyperlink (e.g., our Privacy Policy, Cancellation & Rescheduling Policy, and any program-specific terms). If you do not agree to all of these Terms, you may not use the Site or Services.

We may update these Terms from time to time by posting a revised version on this page. Your continued use of the Site or Services after any changes are posted constitutes your acceptance of the updated Terms.

Order of Precedence. If you enter into a signed agreement or HoneyBook/Squarespace order form with us for specific Services, that signed agreement or order form will control if there is a direct conflict with these Terms.

1. Eligibility & Accounts

  • You must be the age of majority in your state or province (or have the consent of a parent/guardian) to use the Site or purchase Services. Purchases for minors must be made by a parent/guardian.

  • You agree to provide current, complete, and accurate account, contact, and payment information, and to promptly update such information so we can complete transactions and contact you as needed.

  • We reserve the right to refuse service, close accounts, or cancel orders at our sole discretion, including to address suspected fraud, misuse, or policy violations.

2. Educational Use Only — No Medical, Legal, or Employment Advice

The Services are for educational and informational purposes only. The Nurse Rooted Co. does not provide medical care, nursing supervision, clinical orders, legal services, or employment/HR advice. Nothing on the Site or in the Services should be construed as medical or legal advice, nor as establishing a nurse-patient or employment relationship. Always follow your facility’s policies and procedures and consult your licensed healthcare provider, clinical supervisor, legal counsel, or other qualified professional when needed.

3. Platform & Payment Processing

We may sell Services through one or more platforms, including but not limited to Squarespace, HoneyBook, and/or other third-party processors. Those platforms provide e-commerce, scheduling, contracting, invoicing, or payment services. Your use of such platforms is also governed by their respective terms and policies. We are not responsible for third-party platforms.

4. Payment Terms

  • Payment Due at Booking: Payment is due in full at the time of booking unless otherwise stated in writing.

  • Mentorship & Coaching Sessions: Payment secures your appointment on our calendar.

  • Invoices: All invoices must be paid in full before Services are delivered.

  • Non-Payment: If payment is not received, we reserve the right to cancel or deny access to the Services.

  • Refunds: All sales are considered final, except where otherwise permitted under our Cancellation, Rescheduling, and Refund Policy.

5. No Guarantees

Our Services are designed to support your growth, education, and confidence as a nurse. However, we do not guarantee specific outcomes such as licensure, exam success, or employment opportunities. Results vary based on individual effort and circumstances.

6. Pricing, Taxes & Modifications

  • Prices are subject to change without notice. We may modify, suspend, or discontinue any Service at any time without liability.

  • You are responsible for any applicable taxes and fees required by law, which may be calculated and collected at checkout.

  • We may impose reasonable purchase limits per person, household, account, or order to prevent misuse or unauthorized reselling.

7. Scheduling, Cancellations, Rescheduling & Refunds

The following summarizes key points of our Cancellation & Rescheduling Policy (the full policy is incorporated by reference):

  • More than 24 hours’ notice: A 1:1 session may be rescheduled once at no additional charge. No refunds.

  • Rescheduling limit: Each session may be rescheduled one time only.

  • Less than 24 hours’ notice or No-Show: The session is forfeited and not eligible for rescheduling or refund.

  • Group programs/workshops/bootcamps (live or recorded): Non-refundable. If you cannot attend live, recordings/materials may be provided when available.

  • Digital products (templates, downloads, toolkits, etc.): Non-refundable and non-transferable.

  • Emergencies: Exceptions may be granted for documented emergencies at our sole discretion.

  • Where permitted by platform settings, any approved refunds will be returned to the original payment method only. Processing times vary by payment provider.

8. Digital Products — License & Permitted Use

Unless expressly stated otherwise, when you purchase a downloadable product (e.g., PDF, template, workbook, slide deck, checklist), you are granted a limited, non-exclusive, non-transferable, revocable, single-user license to download and use the product for your personal, non-commercial use only. You may not:

  • Share, post, upload, email, distribute, sublicense, sell, or otherwise transfer the product (or access to it) to any other person or platform;

  • Remove proprietary notices or watermarks;

  • Use the product to create a competing product or curriculum;

  • Distribute copies to students, colleagues, classes, or audiences without a separate license or written permission.

We reserve the right to revoke access and/or pursue remedies if misuse is suspected (e.g., bulk downloads, link sharing, file-sharing sites).

9. Live Events, Recordings & Community Conduct

  • We may record live sessions/workshops. By attending, you grant us a limited license to record, photograph, and use your image/voice as part of the program materials, unless you notify us in writing before the session to opt out (note that opting out may limit your participation).

  • You agree to professional conduct: no harassment, discrimination, defamation, infringement, or sharing of others’ confidential information. We may remove participants who violate conduct expectations without refund.

  • Program replays and materials are for enrolled participants only and may be time-limited.

10. User Content; Testimonials; Feedback

If you submit or post comments, testimonials, reviews, questions, or other content (“User Content”), you grant us a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, and create derivative works from that User Content in any media, for marketing and educational purposes, consistent with applicable law and our Privacy Policy. We may moderate, remove, or decline to post User Content at our discretion.

11. Intellectual Property

The Site and Services (including text, graphics, logos, icons, images, videos, audio, downloads, templates, and compilations) are owned by or licensed to The Nurse Rooted Co. and are protected by intellectual property laws. Except for the limited licenses expressly granted in these Terms, no rights are transferred to you. Unauthorized use is prohibited.

DMCA/Reports: If you believe materials on the Site infringe your copyright, please contact us with sufficient detail so we can evaluate and respond under applicable law.

12. Privacy; HIPAA & Confidentiality Boundaries

Your submission of personal information is governed by our Privacy Policy (incorporated by reference). Do not submit Protected Health Information (PHI) or sensitive patient identifiers through the Site, email, chat, or other unsecured channels. De-identify case scenarios before sharing. We are not your employer and do not maintain a designated HIPAA-covered entity relationship for purposes of PHI you submit.

13. Communications; Email/SMS Marketing

By providing your contact information, you may receive transactional or marketing communications from us. You can unsubscribe from marketing emails at any time via the link in the message. If we offer SMS/text messaging: message and data rates may apply; message frequency may vary; you can reply STOP to opt out and HELP for help. Consent to marketing is not a condition of purchase.

14. Third-Party Links & Tools

The Site may reference or link to third-party websites, tools, or resources that we do not control. We provide access to such tools “as is” and “as available,” without warranties or endorsements. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

15. Prohibited Uses

You agree not to use the Site or Services to: (a) violate any law or regulation; (b) infringe others’ intellectual property or privacy rights; (c) harass, defame, or discriminate; (d) submit false or misleading information; (e) upload malicious code; (f) collect or track others’ personal information without consent; (g) spam, phish, crawl, or scrape; (h) circumvent security or access controls; (i) misuse any program access or share paid materials; or (j) engage in any conduct that, in our judgment, harms the Site, Services, community, or reputation of The Nurse Rooted Co.

16. Disclaimers of Warranties

The Site and Services are provided on an “as is” and “as available” basis. We do not warrant that the Site or Services will be uninterrupted, timely, secure, error-free, or free of inaccuracies. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, in no event shall The Nurse Rooted Co., its owners, officers, employees, contractors, licensors, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to your use of the Site or Services, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the applicable Service in the three (3) months preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations on implied warranties or the exclusion/limitation of certain damages, so some of the above may not apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless The Nurse Rooted Co. and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, losses, legal claims, demands, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms or any incorporated policy; (b) your misuse of the Site or Services; (c) your violation of law or third-party rights; or (d) your User Content.

19. Termination

We may terminate or suspend your access to the Site or Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. You remain responsible for all amounts due up to and including the date of termination. Sections intended to survive termination will survive (including, without limitation, ownership, licenses, disclaimers, limitations of liability, and indemnity).

20. Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. You agree that the state and federal courts located in Polk County, Florida shall have exclusive jurisdiction and venue for any claim not subject to arbitration.

Informal Resolution & Arbitration (Optional): Before filing a claim, the parties will first attempt to resolve the dispute informally for 30 days after written notice. If not resolved, either party may elect binding arbitration administered by the American Arbitration Association under its Commercial Rules. Each party bears its own fees/costs unless the arbitrator allocates otherwise. Small-claims court matters may be filed in an eligible court.

21. Severability; Waiver

If any provision of these Terms is held unenforceable, that provision shall be enforced to the fullest extent permitted and the remaining provisions shall remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.

22. Entire Agreement

These Terms, together with policies and any program-specific or signed agreements, constitute the entire agreement between you and The Nurse Rooted Co. regarding the Site and Services and supersede prior or contemporaneous communications.

23. Changes to Terms

We may revise these Terms at any time by updating this page and indicating the Effective Date above. It is your responsibility to check for changes. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
